Workers’ Comp Trial Award – Arbitrator rules against the Employer’s IME doctor

January, 2025 – Mr. Marker took a case to trial before Arbitrator Huebsch in Chicago. The case involved a junior high school maintenance worker who sustained an injury to her knee when she slipped and fell while mopping the hallways. Her injury resulted in a torn meniscus and the need for surgery. The workers’ compensation carrier obtained an IME opinion to dispute that the need for surgery was related to the fall. Arbitrator Huebsch found the need for the surgery was caused by the fall and ruled in favor of the injured worker.

In addition to awarding the surgery, the award included payment of all medical and the employee’s time off work.
