In November of 2024 the firm tried case before Arbitrator Hegarty in Wheaton, IL for an injured worker who was hurt on the job after falling down a 3 story ladder and sustaining injuries to his head, shoulder, neck, back, arm, knees and feet. The insurance carrier denied payment and refused to pay benefits for a number of years.
Marker & Crannell sought penalties against the employer for their non-payment. In Illinois penalties are rare to obtain because the employer only has to have some sort of good faith basis to dispute or fight the case. Mr. Marker was able to argue the employer had no such basis for their non payment and the Arbitrator agreed awarding approximately an additional $40,000 in penalties against the employer (in addition to payments for medical treatment and time off work).
